Brandon used the words 'defeat the oath rod' not 'defeat the oath'.

Mesaana would take the oath if she had no choice. It would be much easier though to not touch the rod and only appear to touch the rod using an illusion. Or to have the flow that she uses to activate the rod barely miss the rod, being an atom away or so. Or perhaps since she has the ability to make her strength in OP seem smaller then it is she also has the ability to make a fake flow of OP and only pretend to activate the rod. There is even a small possibility that the oath rod binding is based on intent at the oath taking and not the words. That would defeat the original purpose of the binder, but the AoL may have had a way around that.

I don't think that Mesaana would swear on the oath rod if she has a choice. Even if she thinks about using T'A'R to create a duplicate oath rod and remove the oaths there is still the possibility that someone will ask her a damning question in the meantime.
