The True Power can only be accessed through the DO's "permission." That's not to say that you need to call him up and ask him every time you want to light a candle, but it does mean that he's able to revoke it at any time, instantaneously.

The only way using the TP against the Dark One would be if he was somehow tricked, or forgot. I could see something being rationalized if you siphoned it through Moridin, but I don't think it's likely.
