Good point. Taking another persons' life is always a big deal. Luigi's act was premeditated, which makes it murder. Penny's was not, so it doesn't meet the legal definition.
My opinion is self-defense or defense of others should be grounds for acquittal. Also that intervening to defend others when most people won't is absolutely heroic. So I guess you and I are in the same boat.
