This is human cognition where one person can say that is valid, and another person says this is invalid. We can always find exceptions and once we find an exception we feel justified in our analysis. Then the other person says that is not justified and in-justified and then we check ourselves and say do we want to work together or we choose not to work together.
If the Democrats keep 9 justices
i) Put a maximum age of a justice of 64, after which you have to do mandatory retirement. Age 64 is when generals are forced to retire.
ii) The consequence is Roberts (65) retires, as well as Breyer (82), Thomas (72), Alito (70), Sotomayor (66).
iii) Leaving Kagan (60), Gorsuch (53), Kavanaugh (55), and whoever Trump Nominates (XX) is that packing the supreme court where the Democrats nominate 6 people in response? It would still be 6-3 just 6-3 in a different direction?
