Just in general issues like the always on Kinect. Facebook within the last few years IIRC made it so that all profiles were set to public by default. Microsoft could do that with the Kinect down the line. Sneak it in and have it watching those people that don't read the terms of use and don't keep up with the news about stuff like that. With the PS$ you aren't required to have a Kinect like device to play, but as far as I'm aware the XB1 still requires it so that would prevent Sony from doing that to their customers who opt to not have a sensor.
