Every time I've used it I thought the hardware was fantastic. It just needs games.

On the other hand, I am fully confident that if I bought it now I wouldn't regret it - the 1st party games are coming, sooner or later, and I've yet to see a Nintendo console that wasn't worth buying for the 1st party games alone.
I'll be picking one up at this new price. Even at the old price, I was just waiting until the holiday season.
Oh, and 3D? Eh. Doesn't matter. Doesn't bother me, doesn't help sell the system to me, it's just a non-factor.

Interesting. I think I'll still wait for better batteries before buying though. *NM*

Are the non-3D games a massive jump on from DSi?

The hardware in a 3DS is pathetic

Well, I stand corrected. It's still a step-up from the DS though, which was ultimately my point.
