Suggesting that a gay judge ruling on the legality of gay marriage bans equates to a heterosexual judge hearing a divorce case doesn't track. Maybe to a heterosexual judge who believes marriage is "until death do us part" and strongly opposes divorce, but that view might just prejudice his ruling. You can't have judges ruling on the legality of laws that directly touch their interests; that seems to me a clear CONFLICT of INTEREST. Are we honestly to believe it's never once going to cross his mind that if the law stands it will be illegal for him to marry the partner of his choice?
