Seriously though, the ACLU needs to put a sock in it. No one should be made to facilitate something he is opposed to because of his beliefs, no matter how ridiculous.
I don't know the letter of the law, but it's obvious that the law is that 1)Discrimination in government based on race is not allowed and 2) Interracial marriages are perfectly legal.
If the judge is saying, "No, I will not grant your marriage license specifically because it is an interracial marriage," it's the same thing as the US Government going "You cannot get married because this is an interracial marriage."
The judge is a representative of the government. He must obey its laws.
Now, if it was a minister of some church, that would not be a legal issue.
The real issue here is whether or not he has leeway to grant or withhold the license. If he DOES have the ability to use his judgment, than he should be able to deny the license on these grounds. No one would fault him for refusing permission for a teenager to marry a significantly older person (in my state, you need permission from a judge to marry if you are only 16), but that is discrimination based on age. The judge is not actually practicing discrimination, since he marries black people, and white people, and apparently does not refuse permission of more blacks than whites or vice versa. No can argue that he is not denying the black party something he is also denying the white party. He is treating them equally.
