Seems an asinine way to legislate, but if that is the only way to get where we need to go, we are indeed stuck with it.

EDIT: Oh, and bear in mind that if "activist" judges had not reverse incorporated the Fifth Amendments Due Process Clause on the states via the Fourteenth EVERY state COULD ban ALL guns, because the Second Amendment would only apply to the FEDERAL government.
