CNS tissue is supposed to be condemned, but often times it ends up in meat products for animals. Those farms want to be paid for all of the animal, so they get around that requirement however they can. Like for instance, they feed some by-products of cows to fish on fish farms.
And yes, from what I've understood, there is a genetic component to CJD, but it's more rare than the spontaneous or acquired variety.
