Apparently some advertising company pulled some images of children offline and used them in a campaign. You can imagine the shock of the parents when they saw their smiling children advertising a product.
The defense is that since the images were published online - public domain - and not copy righted the advertising companies had every right to use them.
Take it for what you will, by the time this is decided, the kids will be old, and the lawyers will be rich.
