The Act applies to "the master or owner of every ship or vessel of the United States", which I interpret that to refer to any ship under US flag - not just those part of the Merchant Marine of which no mention is made.


From paragraph one sentence one of the Act

That from and after the first day of September next, the master or owner of every ship or vessel of the United States, arriving from a foreign port into any port of the United States,

And there's a very obvious reason why Merchant Marine is not mentioned by name in the act and yet I said it specifies them, you may want to consider some additional research on what 'Merchant Marine' is, note that the act also never includes the word sailor either. To save you some research, sentence one of the wiki for US Merchant Marine says "The United States Merchant Marine refers to the fleet of U.S. civilian-owned merchant ships, operated by either the government or the private sector, that engage in commerce or transportation of goods and services in and out of the navigable waters of the United States."

Also, again, the big point is that whole specific 'foreign port' part
