In other words, this is as "unprecedented" as filibustering Bush judicial nominees (i.e. it's not).

John Adams, our second President, passed a health care mandate for privately employed sailors in 1798. See the link for details.
As for Congress’ understanding of the limits of the Constitution at the time the Act was passed, it is worth noting that Thomas Jefferson was the President of the Senate during the 5th Congress while Jonathan Dayton, the youngest man to sign the United States Constitution, was the Speaker of the House.
Unfortunately, when people tell me they the Federal Insurance Contributions Act and resultant SSA Old-Age, Survivors, and Disability Insurance program aren't insurance I think we're into the realm of "don't confuse me with facts". Again, the really absurd thing is that all the conservative challenges to the healthcare law are based on it doing what those same conservatives demanded: Making national healthcare a PRIVATE rather than PUBLIC service. Had Obama told them to go Cheney themselves and pushed through a public option we wouldn't be having this discussion, and would all be a lot better off because, despite their disingenuous motives, the GOP challengers to the law are right that it's a bad idea to require every American purchase insurance from the same private companies that had already made it so unaffordable for so many. Again, whether it's actually unconstitutional or just monumentally stupid and counterproductive remains to be seen.

Yes, did you get the 'foriegn port' part of sentence, or did you stop reading after the comma?
