Yes, the guy killed all those people, and that is abhorrent. But he should have the same rights as anyone accussed of a crime. Any system with multiple standards is corruptable, and wrong.

Also, regarding his in/sanity, there's more to it for getting someone declared insane than just have a psychiatrist she's paid come in and say "Yeah, Loughner's crazy alright", there'll be a court appointed psychiatrist also examining him, not just one guy. And honestly, the guy probably is insane, so i do not believe it would be a miscarriage of justice if he is declared insane. Furthermore, it's possible for him to be declared insane, while also being held responsible for his crimes. it's possible for him to be sent to a psychiatric institution for X years, and then be sent to jail.


Insane or not, you did the deed. So you should have to carry the consequences.



But it does help to explain, and the classification/diagnosis helps determine what the most effective consequences would be. Someone who is not sane can't be held to the same standard as someone who is, just as young children can't and shouldn't be held to the same standard as adults.
