Basically, this means that you get to sue one of two (or more) parties but not both. Once you've made your choice, you have to stick with it, and if it turns out the one you chose to sue is broke, tough luck.

I don't know if that doctrine would apply in the situation we're discussing; I'm just pointing out that it's not always a good idea to cover your bases. Even aside from the extra legal expenses involved in suing more than once.
