We can't be in violation of it, not that it would matter if we were, since it doesn't list that as a condition. It neither explicitly bans or permits gay marriage, nor polygamy, the latter is not an accident of course, regarding the former, at that time there was no question on the matter, as the debate was more focused on whether gays should be decriminalized or punished or subjected to therapy, marriage was really on the table when a big chunk of the countries were sending gays to prison for years.
