Yes, yes, I'm not being helpful, but it's worth pointing out that ideas about copyright weren't always as strict as they are now - sure, Leblanc changed the name of his character to "Herlock Sholmes" after Conan Doyle protested, but, well, the point kind of stands.
Though he appears in minor roles and not as the protagonist, that obviously makes a difference.
