The unswearing was basically just an indirect preparation for the possible later betrayal, not already a betrayal itself. The same applies to Verin gathering info on the BA, DF and Forsaken with the intention to possibly betray it to the Lightside some time in the future. The BA Oath just forbids a direct betrayal, IMO.
