It's much easier to recognize a face without eyes, than to distinguish black cloaks vs dark cloaks.

Do they ban grey cloaks? Brown? Dirty? It's just easier to keep your hood down, especially since the Borderlanders probably want the more camouflaged dark cloaks when out on the road. They can wear their hood up when they're outside a city.
As for disguises, I doubt Fades would wear them. For the most part, they're not assassins, Grey Men are. Fades don't need a disguise if they can teleport between shadows.

Any dark colored cloak is going to look black at night, better to just ban em *NM*
