It's not about what can the Tower do etc... it's about the fact that as an AS Elayne should not being doing these things, she's violating all kinds of rules! A non-AS queen would never even consider these actions!
The Aes Sedai are always breaking the "Rules" whenever it fits them. If I remeber correctly in the New Spring there was a line that were sort of like: You have to know the rules so you know which rules to break.
Part of my point was even if Elayne broke the rules there is not much the Tower can do about it. You are right a non-AS queen wouldn't consider openly making a deal with the Kin. However, Elayne is an Aes Sedai, a queen with a large army, and the lover and bearer of the children of the Savior of the World.
As queen of Andor Elayne is certainly within her authority and rights to make a deal with the Kin. I don't believe the Kin have been incorporated into the Tower. Egwene has talked to Elayne and Nyneave about her plans to include the Kin into the Tower, but I don't recall any mention of that occuring yet. I know the Tower will accept those of the Kin who want to be apprentices. The rest of the Kin are free to do as they want.
The Tower will be in a snit, particulaly Romanda and Lelaine, but what can they do about it? Tell Elayne she can't be a real Aes Sedai, bring economic and political pressure on Elayne, go to war with Andor.
Actually she is not. For 3000 years the Tower has been the sole authority over Channeling. Teh post-Breaking world dictated this set up and as far as we know no monarch has ever tried to openly set up a group of Channelers tied to their throne. What do you think would have happened if Darlin or Alliandre or Tenobia had taken the same actions? It's a certainty that Elayne will get far more leeway and she knows it and exploits it here.
More than that, as an AS she is wrong to help organize a group of Channelers outside of the purview of the Tower.
The Tower is going to come to grips they are not the sole authority over Channeling. The Tower has no control and never has had control over the Windfinders, the Wise Ones, the Kin, and the Black Tower. Elayne found herself in a kind of grey legal area. In Ebou Dar Elayne found out the Kin were left alone by the Tower. The Tower had no idea how many Kin there were, how well structured the Kin were, and short of the Kin sending a few runaway novices back didn't have any contact with the Kin. Why shouldn't a independant monarch think the Tower ignores/doesn't care about the Kin? Why wouldn't a monarch want to use the Kin to help their country economically and socially? As long as the Kin isn't used for war, I think it would be a great benefit for the world if Darlin, Tenobia, etc used the Kin, Windfinders, Wise Ones.
