Maybe he can't transmigration a soul killed by the TP because it damages the soul in some way.
I would rather think that the DO could easier transmigrate a soul, which came into contact with the TP.
Likely the DO can't transmigrate you, though, if there is a way to destroy, imprison or remove the soul from a person (like Mashadar basically did; or also Ishy tried in the end of TDR).
Another idea would be those humans imprisoned in a zara board or maybe mindtrapped people, if the zara board or the mindtrap is destroyed.
