Federal courts have ruled that illegal immigrants have standing to sue employers for violations of the Fair Labor Standards Act (including for paying less than minimum wage). There are lawyers in New York who have made a cottage industry out of finding illegals who are fired from restaurants and then suing the employers for massive amounts of money. Employers are moving away from employing illegals anymore because when the lawsuit starts it also then exposes them to Federal fines for violations of labor laws on proof of residency for employees. In short, the trial lawyers are making it prohibitively expensive to hire illegals. I expect it will spread to other industries and states.
