I don't think the House could even pass the Senate version with no changes, and reconciliation would only work if they get it done before Brown is certified, which would look like an undemocratic thing.
I don't think Brown's swearing in would matter, but I have to admit I don't even really understand how they think they can apply it to the healthcare bill let alone what little issues like changing senators mean to how it is implemented. It frankly sounds like a bullshit method that needs to be banned.
