Of course we all make assumptions when we respond to situations to which we don't have first hand knowledge...
I don't remember the OP mentioning how old the child is. I got the feeling the issue was brewing for longer than a few weeks. But that's just my interpretation, obviously. But when does the grace period end? A month? 6 months? When the baby sleeps through the night? When the child starts school? Graduates? Marries?
You see...this is another HUGE assumption. How do you know that the company does not follow the FMLA? How do you know that the employee didn't have a good amount of time off when the baby was born? Maybe the company has a very liberal family leave policy, but the employee wasted his available time off on a trip to the Bahamas and now is paying the price? Or hadn't worked there long enought to earn paid time off? Huge assumptions? You betcha. But no bigger than yours (unless you have inside information into that company that wasn't posted). Maybe the employee could have taken unpaid time off, but the family needed the money. That's a tough situation, but still his choice.
Millions of people have babies and don't get fired. Maybe their companies have better policies, but I'd bet not all of them do.
That is different, thats "bonding time", I'm not talking about that. I agree people shouldn't use children as an excuse, but during the first few weeks of a new child there are a lot of sleepless nights, this is clearly a temporary thing.

If someone is making excuses because they have children then thats wrong, but the physical effects of childbirth and the resulting few weeks on both the men and women (women obviously more) is something most good companies are aware of and make alloweances for, Lurkers company is behind McDonalds and Burger King in it's employee rights standards.

I took new farther to mean exactly that, new, however it could quite possibly be a few months. In which case you'd be right.
I dont have the imagination to factor in things like holidays, I took the story on face value, which is what I believe is the right way of going about things.
If there is holidays and things involved obviously it's different, but the OP never mentioned any of those.
