The point seemed to be to me that if two people are both intoxicated, whats wrong with them having sex. To say that someone is being raped in that scenario in my mind is wrong. Growing up that was almost the whole point of house parties, college dorm parties, hell even going downtown and hitting the bars, the goal of most of those evenings is to get drunk, and get laid. It was the focus for us, both male and female. The ubderatabding was that if both parties were drunk, its all good.
Now i absolutley do not mean that if two people are drunk and one says no or isnt into it that that gives the other license to "take it" from them. That is in every way rape. To force yourself on someone is always wrong and that behavior beeds to be punished.
If two people are drunk, talking and suddenly fibd themselves making out, go off somewhere excluded and fuck without "proper, prior planning" or without eother party specifically asking for or giving consent, why is that rape? And who is the rapist in that situation? The man? Because wpmen are fragile flowers and he should know better? Thats the precedent i see being set up if sex while intoxicated was to become a crime, the man is going to be charged, regardless of ewho initiated the act. Maybe im cynical and jaded, but that seems to be the trend already happening woth what i refer to as reggretted sex. You go out one night and decide to willingly spend the night woth a stranger, or a friend, whatever ot may be, and in the morning you eake up next to this person and go oh shit, what have i done? This ptoposed shift in the law could see men, and women, who are not predators and are guilty of nothing more than taking the wrong person home, to be wrongly cast into prison amd labelled a sex offender for the rest of their lives. Thats what eorries me.
Can anyone here say that they javent been in that position? I have a daughter bron from a one night drunken stand. I was far more intoxicated than her mother, was i raped? I certainly was willing to go on woth the act, but because i was drunk, and as this article points out, they want to say that intoxication os an automatic no, i couldnt truly have consented so does Ashleys mother deserve to be tried and sent to prison? That notion is ridiculous to me, but should this thought become law, you will WILL, see this scenario play out.
Lije the author says, drunk sex can be great, fun for a night, or a night that leads to years or a lifetime of fun and happiness between two or more people. It can also be akward and strange, but two people, getting drunk and ending up in bed together isnt a crime. We just need to learn to accept that people make decisions, and people make mistakes. But punishing the innocent to get at the guilty isnt the way to go about it.
