Yeah, I know I am bordering on obsessive here... but the assertion really bugged me because it seemed to fly in the face of Florida black letter law and if true would change the entire completion of the case.
The portion dealing with Justifiable force starts on page 64 (section 3.6f) of the 705 page pdf document (yeah it is rather thorough) and I am not seeing ANYTHING along the lines of what Jay asserted.
I know that courts are VERY particular about what instructions can and can not be given to juries because improper instructions given to a jury, that result in a conviction, is a major source for appeals. These standard instructions were crafted by the Florida Supreme court, so I think it is probably a safe assumption that trial judges adhere to them fairly closely.
