I was looking into this further and information suggested the relationship began on the set of the film 'Tess', which was a year after the original case. However, Kinski was 17 by that point (even taking into account the latest of her several birth-dates; she lied about her original age in order to do movies involving nudity earlier than would have otherwise been legal). This led to the assumption that the affair happened earlier, but if so I would have thought that it should have come up during the time of the original trial.
I'm not sure there was any scandal or trial about Kinski, perhaps because she was lying about her age as you note. But yes, he had an affair with her as early as 1976, which led to her starring in Tess three years later.
Is there a good source for info on the Kinski/Polanski relationship? Googling isn't really helping at the moment as it just comes back to this week's news stories.

The civil case began in 1990 and Polanski fought it for seven years before giving in and reaching an out-of-court settlement. The fact that she pursued him off her own back across borders for seven years appears would appear to be 'quite vigorous' in my book. Interestingly, it has been suggested that the victim going public in 1997 with her forgiveness for Polanski may have been part of the terms of the settlement.
Weird. I'm not even sure how you could do a civil case like that, particularly when a criminal case is open but stalled... but yes, that would be "quite vigorous" then.
