Is it constitutional to force people to buy it? It can be pretty expensive. And it would seem to be the same sort of deal. You pay car insurance so that no one is caught with their finances and livelihood ruined after a car accident.

I suppose a difference would be that while car owners might be forced to buy insurance, no one is forced to buy a car. But when you have a car, you need the insurance to protect it.

It seems strange to me (from an admitted outsider perspective) that health care is viewed differently. Everyone has a health, by default. When you have a health, should you not need insurance to protect it, to make sure that no one is caught with their finances and livelihood ruined after a health accident?

I don't know all the ins and outs of the US health care laws and insurance laws and how Obama's legislation works. I'm just wondering things out loud.

I believe (and I can't stress enough that this is not a legal opinion, just the way I understand, rightly or wrongly, the law to work) it's mandatory at the state level, but only for licensed drivers. In other words, I don't think (though I could be wrong) insurance is required to have a license, or even to own a car, only to drive one legally. On the other hand, neither the federal government nor the state of MA (which, of course, has the same mandate to buy insurance) sends people to jail for not having health insurance; they simply impose a tax penalty on those who don't.
