I wouldn't mourn a return to the village / town based society of a previous age where you were judged by a respected group of local elders. In the vast majority of cases, this brought about swift, accurate justice.


I find it counter intuitive and unprovable.

Plus, it seems somewhat diametrically opposed to your quote critiquing lawyers. your historic village elder types are the priests, witch doctors and what-not.


Is that they would use a form of justice that is acceptable on an intuitive level to the vast majority of the community.

Once the law becomes so obscure and technical as it is today, that link is lost.

And by village elders, I don't refer to witch doctors etc. In such a hypothetical situation, I would mean men of respect in the local community - your blacksmith, your baker, your landowners etc.

Men who would use right and wrong to reach a "common sense" verdict. Not legal technicalities.

If a guy was caught on a stolen horse, he was a horse thief, and horse thieves got hung. End of story.
