As I say, I'm not familiar with Spanish law, so I honestly don't know, but if not you have the same problem that exists here: A civil and religious institution that share the same name, as well as many of the same attributes, despite being wholly separate practices.
I would assume it's the same way as in the rest of continental Europe: a church wedding only being possible after (generally immediately after) a civil wedding ceremony. Because then my response is the same as here, because the situation is the same: Does the Pope REALLY want the Spanish government regulating Catholic sacraments within its borders? Didn't Europe settle that argument with the Thirty Years War?
Not that it really matters anyway because as far as the Pope is concerned such distinctions are meaningless; in the eyes of the Catholic Church you were either married within the Catholic Church (e.g. sacramentally) or you aren't married. There's no reason why the Pope should find homosexuals in the latter state any more objectionable than anyone else in it, but from the perspective the Pope is REQUIRED to take, "gay marriage" has no more standing than "Islamic marriage".
You say there's no reason why he should, but there's every indication that he does, as shown again here.
No reason he should care more; every reason he should comment more in Spain given their recent legislation. If they passed a law declaring murder legal I'm fairly certain he'd condemn that, too.
Speaking of which, I think you were a bit unfair to Pius XI in your other comment here. He condemned the "conspiracy of silence" among Western politicians who watched mutely as German Catholics went to concentration camps for smuggling Pius XIs polemic against racism and publicly criticized many core Nazi concepts. Wikipedias description of his basic attitude makes him sound almost socialist, but when Republican Spain deported priets, seized church property and banned church schools, along with murdering hundreds of clergy they never bothered to deport, is Pius XIs opposition to them support for Franco, or for the Catholic Church in Spain?
Think of it this way: Your neighbors are fighting to the death. One of them hates all liberals and has vowed to hunt down and kill each of them; the other feels the same way about Samoans. Which one's likely to put a bullet in you if he wins, and, based on that, which are you going to directly oppose? You may only condemn the beliefs of the other in passing, but just because they and you are actively fighting your common foe for bare survival doesn't make you comrades, it simply means you have a common interest at the moment. How harshly do you expect the man to speak of Franco from Mussolinis backyard?
That's the kind of aggressive secularization condemned by both Benedict now and Pius then. I condemn it just as strongly, and recognize that it went into overdrive after the disillusionment, waste and horror of the Great War, guarantee I hate post modern nihilism every bit as much as Benedict does. That make me a Franco supporter? Sorry, but if you want to condemn a current head of state for supporting Franco, Juan Carlos is probably a better choice than Benedict, doncha think?
