Things which are essential to life shouldn't be optional.


We can make millions of choices to act against what is essential to life. You can't legislate away the possibility of making a mistake.


Like what? Hundreds of choices which are far less detrimental to life are forbidden. Suicide, for one, is illegal. So many of our freedoms are already as you say, "legislated away." You're not even free from drugs! It just takes a physician to decide you're not acting in your best interests, and you can be confined and medicated for the rest of your life.

I believe practicality is the answer. Weigh the degree of freedom lost versus potential adverse outcome.
