He was informed that he didn't have to speak but chose to anyway. If you grow up in he US and you are not smart enough to ask for a lawyer then you didn't watch enough Law and Order. It is not societies responsibility to protect stupid people from themselves just to protect the rest of us from them.

As in, if you're aware that you should say "I'm not going to say anything" or "I invoke my Miranda rights", you say those words and you're safe - interrogation ends until your lawyer is there. If you're not aware that you should say those words, you can still keep silent, but the police can keep asking you questions for hours and in the end you might crack and give something away.
