You asked, essentially 'by what right do particular countries hold nuclear weapons?'
I merely wished to point out that there are authorities in international law that you might wish to consider. By what right, you might also ask, did the USSR put a man into orbit? I hope you understand that there is no authority to stop them.
The answer is this: Countries that develop nuclear weapons on their own or in cooperation with others cannot be stopped. The UN has no legal right to do so. The UN cannot stop the US, China, Great Britain, Russia, France, Israel, etc... from building nuclear weapons, got it?
So now you might (if you are puzzled by the US asserting authority to stop Iraq or North Korea from developing nuclear weapons) wonder why Iraq is in trouble. The answer is the Nonproliferation Treaty, which Iraq signed, which forbids it from doing so. The reason they signed was (ostensibly) to gain access to dual-use technology. [Important note here: Israel did not sign the NPT. Pakistan did not sign the NPT. India did not sign the NPT. France did not sign the NPT. etc... They all got ahold of/developed nuclear weapons anyway. Iraq could have followed the same path, and there would be little anyone could do about it.]
No, of course not. I mean, it might actually spawn a serious argument. Correct me if I'm completely wrong, I mean, I'm just a little, naive kid who doesn't bother to quadruple check my arguments, but isn't the USA a member of the UN? I mean, I can safely assume that? Cuz if it is, should it be excused from the regulations and treaties that follows? If you right now say, in writing, that, yes, I, aeroccontrols, think that my nation is superior to all others, and has proven numerous times that it is more capable of handling a situation, be it financial or an act of war, than any other country, well, we'd get that out of the way at least.
The US should certainly abide by its treaty agreements. If you would like to make a specific charge that we have not, then we can discuss it.
