There is an obvious difference between free speech and whining

By definition the two mean different things. Hence 'whining' and 'free speech' are not synonyms.
However free speech should allow any one to say anything (barring certain legal issues and taboos and the like). Last I heard, whining wasn't illegal and American society isn't suppressed enough to make it taboo.
Refute the complaints. Don't just tell the person to shut up.
